u.s. senator chuck hagel set to be sworn in this morning as the new secretary of defense. the 7 week fight over the nomination ended yesterday as the senate voted 58-41 to confirm him. hagel is a republican but got the votes of only four fellow republican senators. many in the gop feel he is hostile towards israel and too soft on iran. >>> 5:17 right now. we are continuing to follow this breaking news in san francisco. a big water main break causing a mess in one neighborhood. >> 1.5 feet deep water and a lot has gone down since. >> backed up to it. we are talking about west portal neighborhood the area near 15th and wawona. look at this video incredible stuff. homes and cars flooded. use west portal in the meantime. elsewhere a live look outside overnight roadwork was picked up in oakland and san leandro. to the maps, if you are traveling westbound 580 brake lights in the eastbound direction going against the commute, possibly because of this overnight roadwork still in lanes until 11:00 this morning approaching north greenville road. else

a new defense secretary finally. chuck hagel was sworn in this morning at a private ceremony at the pentagon. he is planning to address department employees later today. the full senate confirmed hagel yesterday and he released a statement saying that he is incredibly honored to be tasked with heading up the department of defense and he plans to work closely with congress to protect this great nation and to make sure we maintain the world's strongest military. >> first lady michelle obama is on the move the next couple of days to continue to promote the third anniversary of her let's move program. you may remember that she teamed up with big bird to release a couple of public service announcements last week urging kids to eat better and exercise more. i like the excuse to show big bird dancing again. today she travels to clinton mississippi where child obesity is down 13% from 2005. state officials attribute much of the change to a 2007 law that required more p.e. in schools and better food on cafeteria menus. >>> the first lady championed a federal law mandating healthier sc

to new taxes. other than that, they're divided by chuck hagel and a legislative and pr strategy for dealing with the sequester, divided about immigration, divided to some extent about just the general posture towards the president. and i think you see in that poll, you know, you say who's the republican party unpopular with? to some extent obviously with democrats. but the reason the number's down so low is a lot of republicans are unhappy with the party. some from the right and some from the left. i think right now the president and his team are firing on all cylinders on the pr war leading up to the sequester. and republicans have put themselves in a weakened position. a lot of long-term issues as well. >> when your brand is in the 20s, you're in harry truman and george w. bush territory. it's just not good. and you know, the president is winning the day on a lot of issues, especially when it comes to dealing with gun violence. if you look at the poll, overwhelmingly, americans think that this country needs stricter gun laws. that obviously is an offshoot of not only newtown b

. but sometimes i read in the newspapers that republicans are filibustering, for example senator hagel as if a majority of republicans or a majority of the senate intended to deny the nomination to senator hagel through a filibuster, when in fact what most of the republicans were saying was the nomination of the former senator has come to the floor only two days ago. we have senators who got legitimate questions about the nomination and we'd like some time to discuss it. in that case we were forced to have a vote on a motion by the majority leader to cut off debate on thursday before the recess even though the democratic leadership and the white house had been told by republican senators, enough of us, that if we voted after the recess there would be plenty of votes to make sure that the president's nominee had an up-or-down vote, as we have done throughout history in the united states senate. for whatever reason, the majority leader and the white house felt that they had to push through a vote and then went into a large complaint that republicans are filibustering the president's nomi
